THE COMPANY means Designer Lifestyle Ltd trading as Leather Sofas Online Registered in Scotland SC288799. These conditions and the contract shall be subject to and construed in accordance with the Law of Scotland and do not affect your statutory rights.
The Customer means the person or company assuming responsibility for the payment of goods.
An Order means the customer has made a request for goods from the company but this may be subject to change.
A Contract means an agreement has been reached by both the customer and the company and the customer has confirmed.
Acknowledgement means written or e-mail confirmation of your order. It is not confirmation of the ability to supply.
The End User means the person or company or appointed agent that will utilize and/or receive the goods.
Although the Company takes great pains to ensure that all information supplied to the customer by way of description and/or illustration is correct and accurate. It remains the responsibility of the customer and/or the end user or their agent to:
1. Determine the suitability of the goods for the required application.
2. Check the acknowledgement and report any irregularities (ie model, make, colour) immediately within 24 hours
3. Check the item being delivered for correct coding to packaging, damages, colour and then to sign the proof of delivery.
4. The order becomes a contract only after the company has confirmed its ability to supply the said goods.
The Company only accepts an order once a payment is made and confirmed by our payment partner or bank.
The exchange of funds is not deemed an acceptance of contract. It is the acceptance of order to supply goods yet to be confirmed by both parties. In the event the customer and/or the end user or their agent accepts goods that subsequently are found to be incorrect there may be a charge to affect the exchange. In this situation the company does not accept responsibility for the delivery of incorrect goods and it is deemed that the contract is complete.
The company will in each and every event attempt to satisfy the customers and/or end users request for as long as the company or other customers do not suffer any losses.
The Company cannot be held responsible for errors in descriptive, pictorial or written material issued or published by the manufacturers of goods offered for sale.

If in the unlikely event a pricing mistake is discovered pertaining to your order, be it prior or post any payment you will be contacted immediately. You will then have the choice of accepting the corrected offer ordering another product or having your order cancelled and any money paid refunded in full.

Delivery is to one address for upholstery items, ottomans and other products, but including all other sofas and sofa beds, armchairs and corner seating, which are delivered by a 2-man team. Charges and delivery methods for other products will be as specified from item to item. We only deliver to UK mainland addresses.
Deliveries are normally to the ground floor but if we have been previously informed we will also deliver to other floors. However it is the responsibility of the customer and/or end user to advise us of any difficulties that may be encountered at point of delivery - for example steps, narrow doorways, staircases, soft pathways or difficult road access.
Where delivery is requested to awkward situations it will be at the discretion of the delivery team to complete such a delivery. It will also be the full responsibility of the customer and/or end user or appointed agent to settle any claims for damages resulting from such a request be they to goods, property or persons. Neither the company nor its insurers will accept such claims.
We reserve the right to fail delivery if we have not been informed that:
1. Access to the property is deemed too difficult and/or dangerous
2. Delivery is to a floor other than the ground floor,
3. The customer and/or end user or their agent is in any way difficult or abusive.
4. The customer or their agent is not present when this has been previously agreed
As it is the responsibility of the customer and/or end user to advise us of any difficulties that may be encountered at point of delivery - for example steps, narrow doorways, staircases, soft pathways or difficult road access - in the event of a failed delivery that is due to access difficulties, there will be a charge of £85 for the failed delivery.
In the event of a failed delivery that is due to the customer or their agent not being present when this has been previously agreed, there will be a charge of £85 for a subsequent delivery.
Please ensure that you are ordering precisely what you require to avoid any unnecessary expense later. If the goods which are delivered are not what you ordered this must be reported on the day of delivery by email, advised to the delivery team and noted on the delivery sheet. We do not accept cancellations or returns of non-faulty made-to-order goods.
NON-FAULTY GOODS
Because we are online sofa specialists we offer a unique Money Back Guarantee, FREE return service for upholstery items, excluding made-to-order sofas, beanbags, ottomans and other products, but including all other ready-made sofas and sofa beds, armchairs and corner seating, which are delivered by a 2-man team. If you change your mind when our two-man team deliver your ready-made sofa (excluding made-to-order sofas) and see it in your living room, they will take it back right away. This allows us to use the same vehicle journey and delivery team to collect the goods and to protect the furniture with the original packaging. Your money will be returned in full to the same credit card or by cheque whichever was originally used for the transaction.
If however you decide to return any non-faulty ready-made goods at any time after the original delivery vehicle has driven away from the delivery address - for example a couple of days later - then we will charge you the cost of the collection and the original delivery, which can total £150. So you can return non-faulty ready-made goods up to 8 days after they are delivered, but to enjoy the FREE return service they must be re-packed and taken away at the time that the delivery is made. Also if a non-delivery results from difficulties due to access - for example steps, narrow doorways, staircases, soft pathways or difficult road access - there will be a charge of £85 for the failed delivery.
You will appreciate therefore that it is very important that you are at home when the delivery is made to take a decision while the delivery team are still there. To take advantage of our Money Back Guarantee, FREE return service for ready-made goods we suggest that you order a FREE leather sample and check that the goods you have ordered will fit through all the openings to the place where you want to put them in your home. We do not accept the return of non-faulty made-to-order goods.

NON-FAULTY READY-MADE GOODS RETURNED AFTER THE DELIVERY DAY
Ready-made goods that are returned after the day of delivery must be returned within 8 days to the warehouse in their original packaging and condition and you will receive a full refund excluding the original delivery charge. You must also pay the cost of returning the goods and this is non-refundable. If you are unable to return the goods yourselves, we can arrange for this to be done on your behalf, but we will charge you for this service. Where you wish to return an item that is not an error on our part this will incur a re-stocking charge, which may be as high as 50% of the value of the goods. Unfortunately goods that have been used cannot be accepted for credit.
We do not accept the return of non-faulty made-to-measure sofas.
If there is any visible damage or there are faults in the goods delivered to you, they must be advised to the delivery team and noted on the delivery sheet and reported to us on the day of delivery by email to info@LeatherSofasOnline.co.uk. Any damage and/or faults reported after this time, that have not been caused by improper use, will be treated as a warranty claim and corrected by the appropriate service company appointed to carryout such work if approved by the company.

Refunds will be made within 30 days of notification, to the same credit card that was used for the transaction or by cheque whichever was originally used for the transaction. We do not offer refunds of made-to-measure goods.
When you place your order we take full payment for the goods online or by cheque and you will be contacted regarding the delivery date. We do accept cheques, however all cheques must clear the bank before the order will be processed. This will add a minimum of 5 working days to your delivery date. For your protection, delivery should be to the address to where the credit card is billed. If there is a genuine reason for delivering to a different address please advise us by email. We will need to see proof of your connection to the delivery address, e.g. If you are moving house, then we can deliver to your new address.
It is important that you inform your credit card company that you are ordering goods to a different address than the invoice address.
